Terms of Use
These Terms of Use (“Terms”) govern your use of www.emfff.com (the “Site”), operated by the East Meadow Firefighters Foundation (“EMFFF,” “we,” “us,” or “our”), a 501(c)(3) non-profit organization based in East Meadow, New York. By using the Site you agree to these Terms.
1. Use of the Site
The Site is provided for informational purposes and to facilitate donations to the Foundation. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site.
2. Donations
Donations are processed by Square. Square’s terms of service apply to the payment transaction itself. We acknowledge donations and issue tax-deductible giving receipts in accordance with IRS rules for 501(c)(3) organizations.
Refund policy
All donations are final. We will, however, refund documented errors (duplicate charges, an incorrect amount, or a charge you did not authorize) within 30 days upon request. To request a refund, email [email protected] with the donor name, donation date, and amount.
3. Intellectual property
All content on the Site, including text, images, logos, the Foundation name, board roster, and graphics, is owned by or licensed to the East Meadow Firefighters Foundation and is protected by United States and international copyright and trademark law. You may view and share links to the Site, but you may not reproduce, distribute, or create derivative works of any content without prior written permission.
The EMFFF name and logo are trademarks of the Foundation and may not be used to imply endorsement, partnership, or affiliation without written permission.
4. External links
The Site contains links to third-party websites (including the East Meadow Fire Department, our payment processor, and analytics provider). We are not responsible for the content or practices of those sites.
5. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
6. Limitation of liability
To the fullest extent permitted by law, the East Meadow Firefighters Foundation, its directors, officers, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to loss of data, loss of profits, or service interruption. Our total liability for any claim arising from your use of the Site shall not exceed one hundred US dollars (US$100) or the amount you donated in the preceding twelve months, whichever is greater.
7. Indemnification
You agree to indemnify and hold harmless the East Meadow Firefighters Foundation and its directors, officers, volunteers, and agents from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms.
8. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to the personal jurisdiction of those courts.
9. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.
